The Story Behind the Law

The Virginia Graeme Baker Pool & Spa Safety Act (VGBSSA) was named after Graeme Baker, the granddaughter of former U.S. Secretary of State James Baker III. In June 2002, Graeme tragically lost her life due to suction entrapment in a spa drain. Her story became the driving force behind stronger federal pool safety regulations, ultimately leading to the passage of the VGBSSA in 2007.

This critical legislation aims to reduce drowning incidents, prevent entrapments, and enhance overall pool safety—particularly for public pools and spas.


Why the VGB Pool & Spa Safety Act Matters

Each year, thousands of children suffer from pool-related accidents, many of which involve drain entrapments caused by strong suction forces. The VGBSSA was introduced to:

  • Enhance the safety of public and private pools & spas
  • Reduce suction entrapment injuries and deaths
  • Promote the use of protective barriers and safety equipment
  • Encourage proper supervision and drowning prevention strategies

According to the U.S. Consumer Product Safety Commission (CPSC), drowning remains the leading cause of unintentional death for children aged 1-4 years old. Many of these tragedies are preventable through improved pool safety regulations, compliant equipment, and increased public awareness.


Key Requirements Under the VGBSSA

The Virginia Graeme Baker Act establishes several mandatory safety measures for public pools, spas, and commercial aquatic facilities. As of December 19, 2008, all public pools and spas must:

🛑 Install Anti-Entrapment Drain Covers – New drain covers must meet ASME/ANSI A112.19.8–2007 standards to prevent entrapment.

⚠ Implement Secondary Safety Measures for Single Main Drains – Facilities with a single drain system (except unblockable drains) must add at least one of the following:

  • Safety Vacuum Release System (SVRS)
  • Suction-limiting vent system
  • Gravity drainage system
  • Automatic pump shut-off system
  • Drain disablement or another approved safety system

🔍 Ensure Compliance for Public & Commercial Pools – All public pools must meet federal anti-entrapment safety requirements.

💡 Encourage Layers of Protection – Pool owners should implement additional safeguards, such as:

  • Self-latching gates & isolation fencing
  • Door & pool alarms
  • Active supervision for young children
